Terms of Service

These Terms of Service ("Terms") govern your use of the SyncMyTrade platform and services operated by SyncMyTrade ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Overview of Service

SyncMyTrade is a cloud-based trade copying platform that allows you to replicate futures trades from a master account to one or more follower accounts across supported brokers. The Service includes the web dashboard, trade copying engine, and related APIs.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding agreement to use the Service. By using SyncMyTrade, you represent that you meet these requirements and that all information you provide is accurate.

3. Account Responsibilities

You are responsible for:

• Maintaining the security of your account credentials and connected broker tokens
• All activity that occurs under your account
• Ensuring your broker accounts comply with your broker's and prop firm's terms of service
• Notifying us immediately if you suspect unauthorized access to your account

We are not responsible for any losses resulting from unauthorized access to your account due to your failure to secure your credentials.

4. Trading Risk Disclaimer

Trading futures involves substantial risk of loss and is not suitable for all investors. You acknowledge and agree that:

• SyncMyTrade is a trade copying tool, not a financial advisor or broker
• We do not provide investment advice, trading signals, or recommendations
• Past performance of any trading strategy does not guarantee future results
• You are solely responsible for all trading decisions made through your accounts
• You may lose more than your initial investment when trading futures
• Trade copying introduces additional risks including execution delays, partial fills, and technology failures

SyncMyTrade is not liable for any trading losses, missed trades, incorrect executions, or financial damages arising from the use of the Service.

5. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, broker API outages, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime.

6. Subscription and Billing

Free Trial

New accounts receive a 14-day free trial. No credit card is required to start the trial. At the end of the trial, you must subscribe to a paid plan to continue using the Service.

Paid Plans

Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan. Prices are listed in USD on our pricing page and may be updated with 30 days' notice.

Cancellation

You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. Upon cancellation, your copy groups will stop executing but no positions will be automatically closed.

Refunds

We offer refunds on a case-by-case basis within 7 days of a charge if the Service was materially unavailable during that period. Contact support@syncmytrade.com for refund requests.

7. Acceptable Use

You agree not to:

• Use the Service to violate any law or regulation, or any broker/prop firm terms of service
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Interfere with or disrupt the Service or its infrastructure
• Share your account credentials or allow others to use your account
• Use the Service to manipulate markets or engage in fraudulent trading activity
• Resell or redistribute the Service without our written consent

Violation of these terms may result in immediate suspension or termination of your account.

8. Intellectual Property

All content, code, designs, trademarks, and intellectual property associated with SyncMyTrade are owned by us and protected by applicable laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

9. Limitation of Liability

To the maximum extent permitted by law, SyncMyTrade and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, trading losses, data loss, or business interruption, arising from your use of or inability to use the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless SyncMyTrade from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Third-Party Services

The Service integrates with third-party broker APIs (Tradovate, Projectx, Rithmic, etc.) and payment processors (Stripe). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or actions of any third-party service.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice on the Service at least 30 days before they take effect. Your continued use of the Service after changes constitutes acceptance. If you disagree with updated Terms, you may cancel your account.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario, Canada.

14. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in activity that is harmful to the Service or other users. In the event of termination for cause, no refund will be provided.
